Virtual courts and digital India

As Covid pandemic 2019 struck humanity, the world fell behind as time stayed stil





Human life and the justice system crawled and delayed as it failed to reach the height of technology. Every business stood still. Courts were no exception to it. No court functioned for months together as physical appearance was banned and restricted. Our cases fell short to Justice. Non-functioning of the court created havoc in our country leaving lawyers and the court helpless, unemployed and powerless to conduct their day to day activities. Law Firm and court were re-innovated to pursue the revolutionizing idea of taking everything online. No doubt it was a difficult challenge to attain. A hazardous task to bring the courts online all over the country yet running on decades old traditional systems was pursued.


This much needed question to completely switch to modern technology and rely on it raised many questions to the fear of unknown , safety and independence of functioning of courts, dissociation of change, adequate rules of procedure, compliance and evidence stood in the way. Judiciary, no doubt played a wonderful role in allowing every state to make their own local law to hear their cases independently allowing ease of mobility and access to every lawyer to present their cases in court without any delay. To maintain the requisite knowledge and skill, the court and its associate learned to keep abreast of the change and updated themself with the technology to keep up the change of the society.


Application of technology helped us in regaining our strength of letting our lawyers back in the field without exposing themself to the fear of being affected by the deadly epidemic among us. it also allowed court to - 1) Speedy recovery of all the backlog cases, 2) all the cases that were kept onhold for continuous interim extension, or stay due to covid SOP protocol could be heard again by the due process of law. 3) Lakhs of monetary expenses that came out of pocket citizens as taxes which were being wasted due to the halt of court could yet again be used , recovered and managed appropriately. 4) Ease of doing business and accessibility of appearance in court virtually became utmost significant as one could appear in any court in spite of their locational or geographical boundaries. Today in the midst of one and a half year of covid epidemic, our Honorable Supreme Court and High Court have successfully managed to run a triumph over it in spite of the challenges we are facing in day to day life. It was a gasp of breadth much needed to our traditional court system. We, the assistant of law of land , should in promising future uphold and move forward to bring all lower courts and clients to deal with our cases online. The importance of growing technology could be felt by the lawyers young or senior who updated themself for this rigorous task. The power of the future of the judiciary lies in virtual and technological upliftment buffing its way forward, saving the precious time of the courts and its seeker. This Technological advancement of our judiciary is no doubt a miraculous boon and a precedent in the history of Independent India where the future is an un-recognized possibility.
